Industry and Tier II Reporting

Requirements for submission: Under Occupational Safety and Health Administration (OSHA) regulations, employers must maintain a Material Safety Data Sheet (MSDS) for any hazardous chemicals stored or used in the work place. Approximately 500,000 products have MSDS’s.

According to the Emergency Planning – Community Right to Know Act (EPCRA) of 1986, if the company is has any MSDS’s on file for any hazardous chemicals stored or used in the work place, and one or more of the chemicals is stored in quantities equal to or greater than the Threshold Planning Quantity (TPQ) for that chemical, then a Tier II form must be filed for every year that any of the chemicals exceed the TPQ. A Tier II form must also be submitted annually for all applicable chemicals, due March 1st.

What are the reporting thresholds established under EPCRA, Section 312?

Extremely Hazardous Substance (EHS) – 500 lbs or the threshold planning quantity
(TPQ), whichever is less
Hazardous chemicals – 10,000 lbs of an OSHA hazardous chemical

Who must receive the Tier II report?
If a Tier II report is required, it must be submitted to three places:  Douglas County LEPC, local fire department and the State of Colorado Emergency Planning Commission.  You are highly encouraged to use the EPA’s Tier2Submit software for submittal. If your company would like training on how to use this software, email Douglas County LEPC with your request.
